These Terms of Service (herein referred to as "the Agreement") document the legally binding terms and conditions attached to the use of http://www.oldmissionboat.com (herein referred to as "the Site") which is owned and operated by Old Mission Boat Company LLC (herein referred to as "OMBC") and any and all products and services provided or sold by OMBC (herein referred to as "the Products"). By accessing and using the Site and/or the Products, you accept and agree to be bound by the terms and provisions of the Agreement. In addition, you shall be subject to any posted guidelines or rules applicable to the Site or the Products. All such guidelines or rules are hereby incorporated by reference into the Agreement.


The privacy policy applies solely to information collected by the Site or agents of OMBC. OMBC holds some customer information on file, including but not limited to: name, address, phone number, email address, and purchase history, however, OMBC does not keep customer credit card data on file. OMBC is the sole owner of the information collected on the Site. OMBC will not under any circumstances disclose your personal information to a third party without your written consent, other than as necessary to fulfill your request (eg. to ship an order). OMBC may contact you via email, standard mail, or phone to notify you of new products and services, sales events, news, or other such items. You may opt out of any future contacts from OMBC at any time. Additionally, you may contact OMBC via email or phone to request documentation of your personal information held on file, to makes changes or corrections to your personal information, to request permanent deletion of your personal information, or to express any concerns regarding the use of your data.

OMBC takes precautions to protect the personal information which is held on file both online and offline. The information is stored on third party password protected platforms. All credit card data is processed by payment gateway services Stripe (http://www.stripe.com) or Paypal (http://www.paypal.com). Credit card data does not reach the hosting server of the Site. Secure connections encrypted with SSL are used when handling credit card data on the Site and transferring this data to Stripe. OMBC disclaims all liability for any damages resulting from the theft of personal information collected by the Site or stored by OMBC.


You agree to provide true, accurate, current, and complete information when using or registering with the Site. It is your responsibility to maintain and promptly update this account information to keep it true, accurate, current, and complete. If you provide any information that is fraudulent, untrue, inaccurate, incomplete, or not current, or OMBC has reasonable grounds to suspect that such information is fraudulent, untrue, inaccurate, incomplete, or not current, OMBC reserves the right to suspend or terminate your account without notice and to refuse any and all current and future use of the Site.

OMBC may, but is not obligated to, monitor or review any areas on the Site where users transmit or post communications or communicate solely with each other, including but not limited to user forums, email lists, reviews and comments on the Products, and the content of any such communications. OMBC, however, will have no liability related to the content of any such communications, whether or not arising under the laws of copyright, libel, privacy, obscenity, or otherwise. OMBC may edit or remove content on the Site at their discretion at any time.

You may not upload or transmit any material that infringes or misappropriates any person's copyright, patent, trademark, or trade secret, or disclose via the Site any information the disclosure of which would constitute a violation of any confidentiality obligations you may have.

You may not upload any viruses, worms, Trojan horses, or other forms of harmful computer code, nor subject the Site's network or servers to unreasonable traffic loads, or otherwise engage in conduct deemed disruptive to the ordinary operation of the Site.

You are strictly prohibited from communicating on or through the Site any unlawful, harmful, offensive, threatening, abusive, libelous, harassing, defamatory, vulgar, obscene, profane, hateful, fraudulent, sexually explicit, racially, ethnically, or otherwise objectionable material of any sort, including, but not limited to, any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law.


You may use the Builder's Forum (herein referred to as the "Forum") for the sole purpose of sharing and exchanging ideas with other users. You may not use the Forum to violate any applicable local, state, national, or international law, including without limitation any applicable laws relating to antitrust or other illegal trade or business practices, federal and state securities laws, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, and any U.S. laws, rules, and regulations governing the export and re-export of commodities or technical data.

You are expressly prohibited from compiling and using other users' personal information, including addresses, telephone numbers, fax numbers, email addresses or other contact information that may appear on the Forum, for the purpose of creating or compiling marketing and/or mailing lists and from sending other users unsolicited marketing materials, whether by facsimile, email, or other technological means. You also are expressly prohibited from distributing users' personal information to third parties for marketing purposes. OMBC shall deem the compiling of marketing and mailing lists using users' personal information, the sending of unsolicited marketing materials to users, or the distribution of users' personal information to third parties for marketing purposes as a material breach of this Agreement, and OMBC reserves the right to terminate or suspend your access to and use of the Forum or the Site and to suspend or revoke your membership in the consortium. OMBC notes that unauthorized use of users' personal information in connection with unsolicited marketing correspondence also may constitute violations of various state and federal anti-spam statutes. OMBC reserves the right to report the abuse of users' personal information to the appropriate law enforcement and government authorities, and OMBC will fully cooperate with any authorities investigating violations of these laws.

Although sections of the Forum may be viewed simply by visiting the Site, in order to access some Content and/or additional features offered at the Forum, you may need to sign on as a guest or register as a member. If you create an account on the Forum, you may be asked to supply your name, address, a User ID and password. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur in connection with your password or account. You agree to immediately notify OMBC of any unauthorized use of either your password or account or any other breach of security. You further agree that you will not permit others, including those whose accounts have been terminated, to access the Site using your account or User ID. You grant OMBC and all other persons or entities involved in the operation of the Forum the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Forum and in the provision of services to you. OMBC cannot and does not assume any responsibility or liability for any information you submit, or your or third parties' use or misuse of information transmitted or received using the Forum.


The Site contains links to other websites and online resources that are not owned or controlled by OMBC. OMBC has no control over, and therefore cannot assume responsibility for, the content or general practices of any of these third party site and/or services. We advise that you read the terms and conditions and privacy policy of any site that you visit as a result of following a link on the Site. In addition, OMBC provides and sells products that are not designed and/or manufactured by OMBC. OMBC has no control over, and therefore cannot assume responsibility for, any product designed and/or manufactured by a third party. Liability for damages due to defective or poorly designed and/or manufactured products are the sole responsibility of the third party which provided or sold the products. OMBC disclaims all liability for third party products and services.


OMBC may send one or more cookies - a small text file containing a string or alphanumeric characters - to your computer which uniquely identifies your browser when you visit the Site. The Site utilizes a cookie to power the online shopping cart and improve the user shopping experience. A cookie may also be used to help you log onto the Site faster, convey information about how you use the Site, and to track your usage of the Site over time. A persistent cookie remains on your hard drive after you close your browser and may be used by your browser on future visits to the Site. Persistent cookies can be removed by following your web browser's directions. A session cookie is temporary and disappears after you close your browser. The Site and all of its contents and the products and services sold by OMBC are the sole property of OMBC and are, as such, fully protected by the appropriate international copyright and other intellectual property laws. This site and its components are offered for informational purposes only; this site shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the site, and shall not be responsible or liable for any error or omissions in that information.


You agree to defend, indemnify and hold harmless OMBC and its agents, vendors or suppliers from and against any and all claims, damages, costs and expenses, including reasonable attorneys' fees, arising from or related to your use or misuse of the Website and/or the Products, including, without limitation, your violation of this Agreement or the infringement by you of any intellectual property right or other right of any person or entity.


The Agreement is governed in accordance with the laws of Michigan, United States of America.


OMBC reserves the right to modify the Agreement at any time. Changes to the Agreement will be posted on the Site. Your decision to continue to visit and make use of the Site and the Products after such changes constitutes your formal acceptance of the new Agreement. You are responsible for reviewing the Agreement on an occasional basis to check for such changes.


This Agreement is effective until terminated by you and/or OMBC. Should you no longer agree to be bound by the Agreement, we ask and advise that you immediately suspend use of the Site and the Products. If you are dissatisfied with the Site, the Products, and/or the Agreement your sole legal remedy is to discontinue use of the Site and the Products. OMBC reserves the right to terminate or suspend your access to and use of the Site, or parts of the Site, without notice if OMBC believes, in our sole discretion, that such use is (i) in violation of any applicable law; (ii) harmful to our interests or the interests, including intellectual property or other rights, of another person or entity; or (iii) where OMBC has reason to believe that you are in violation of this Agreement.
